FMCSA Return-to-Duty Process: What Happens in Step 6 (And Why You Can’t Skip It)


If you’re a CDL driver working your way through the FMCSA Return-to-Duty process, you might think you're done after completing your SAP program and passing your drug test (Step 5).


Not quite. There’s one final step — and it’s just as important. Let’s talk about Step 6, what it means, who completes it, and how it impacts your status in the FMCSA Drug and Alcohol Clearinghouse.



What Is Step 6 in the FMCSA Return-to-Duty Process?


Step 6 is the final step in closing out your violation in the Clearinghouse.

It confirms that you’ve not only passed your Return-to-Duty drug test — but that you’ve also started safety-sensitive work again under a DOT-compliant trucking company.



Who Completes Step 6?


Unlike previous steps, Step 6 cannot be completed by a CTPA or SAP.

✅ It must be completed by your new or current employer — the trucking company that hired you after you finished your Return-to-Duty drug test.

They are responsible for:

  • Enrolling you in a follow-up drug testing program

  • Monitoring you under DOT guidelines

  • Reporting your first day back to safety-sensitive duties to the Clearinghouse



Why Step 6 Matters

Until Step 6 is reported:

  • Your violation will still show as “open” in the Clearinghouse

  • Employers doing a pre-employment query will see the violation as unresolved

  • It may hurt your future job prospects — even if your CDL is reinstated


👉 Step 6 officially closes your case. It tells FMCSA and all future employers that you’ve not only recovered, but you’ve returned to the road under DOT rules.



What Drivers Should Know

🛑 You can’t complete Step 6 yourself.

🧾 You must be hired by a company willing to work with drivers in Return-to-Duty status.

📊 That company will then file the final report — and your Clearinghouse status will show the violation as closed.
